Full Breakdown

Section 34-618 covers the Commercial general (C-2) district. Subsection (b), Permitted uses, lists uses permitted as of right in C-2 up to fifty thousand (50,000) square feet in gross floor area, and item (31) of that list is medical marijuana treatment center dispensing facilities, right after (30) Pharmacy. Buildings or developments that contain listed uses and exceed fifty thousand (50,000) square feet can only be approved under section 34-622, the Planned Unit Development district standards and procedures.

The two other districts that name dispensaries treat them as conditional uses subject to the standards and procedures in section 34-546 et seq. The Commercial limited (C-1) district lists them as item (21) of its conditional uses in § 34-617(d), and the Central business district (CBD) lists them as item (10) of its conditional uses in § 34-623(e). A conditional use means a hearing and approval process, not an over-the-counter zoning check. The district use lists reviewed name no other district for these facilities.

Wherever a dispensary locates, § 34-726(a) applies on top of the district rules. It may not be located within five hundred (500) feet of the real property of a public or private elementary, middle or secondary school, and it may not operate between 9:00 p.m. and 7:00 a.m. Section 34-300 defines the facility as a business operated by a medical marijuana treatment center or other organization holding all necessary state licenses and permits, where marijuana and products derived from it are dispensed at retail. The Planning and Development Department administers the district regulations.

Violations & Fines

Operating a dispensing facility in a district that does not list it, or in C-1 or the CBD without conditional use approval, violates the Land Development Code. Under § 34-1202 the Planning and Development Department gives a first notice with a minimum of ten (10) working days to correct, then a final notice and a hearing before the special magistrate, where the city proves the violation by a preponderance of the evidence. The City Council or any interested person can also seek an injunction from the Circuit Court of Duval County under § 34-1203.

Frequently Asked Questions

Where can a medical marijuana dispensary open in Jacksonville Beach?
As of right in the C-2 commercial general district, listed as item (31) of the permitted uses in § 34-618(b). It is also a conditional use in the C-1 commercial limited district and the central business district. The other district use lists reviewed do not name dispensing facilities.
Does a dispensary in C-1 or the CBD need a hearing?
Yes. Both districts list dispensing facilities under conditional uses, which are permitted subject to the standards and procedures established in section 34-546 et seq. In C-2 the use is listed among the uses permitted as of right, so no conditional use approval is printed there.
Has Jacksonville Beach banned dispensaries?
The Code export does not print a ban. It lists dispensing facilities in three commercial districts and regulates them in § 34-726 with a 500 foot school buffer and a 9:00 p.m. to 7:00 a.m. closing window, so the Code treats them as a regulated use.
What size limit applies to a C-2 dispensary building?
Section 34-618(b) applies its permitted uses to single or multiple use buildings or developments not exceeding fifty thousand (50,000) square feet in gross floor area. Larger buildings or developments containing listed uses can only be approved under the Planned Unit Development procedures in section 34-622.
