Springfield, OR Cannabis Regulations: Buffer Zones (2026)

Springfield Development Code section 4.7.177 governs Marijuana Retail Outlets citywide. Under subsection (A), a retail outlet must be licensed under Oregon Revised Statutes and Oregon Administrative Rules, licensed separately under Chapter 7 of the Springfield Municipal Code, fully contained in a permanent building, and located only in the Community Commercial (CC) or Major Retail Commercial (MRC) District; every other zoning district prohibits the use outright. Subsection (B) layers three distance buffers on top of that district limit: 1,000 feet from any public or private elementary, secondary or career school attended primarily by minors, measured as a straight-line radius from the school's property boundary; 500 feet from a park where minors congregate; and 50 feet from any residential zoning district, including across public right-of-way.

Subsection (C) adds operating conditions: no drive-up window, no operation from a temporary facility, secure storage for exterior refuse containers, no outdoor display or storage of merchandise, no on-site consumption unless a state statute expressly exempts it, and a Marijuana Retail Outlet may never be approved as a home occupation. Subsection (E) protects an already-licensed outlet if a school, daycare or park is later sited nearby, so the new neighbor does not create a violation or block license renewal. Subsection (F) grandfathers a business licensed or registered as of May 17, 2016, though a 6-month lapse in occupancy or licensing triggers the nonconforming-use rules of SDC 5.8.100.

Applications route through Minimum Development Standards review for a change of use in an existing building or full Site Plan Review for new construction, and require both a state license and the City's marijuana business license before occupancy.
