Texas does not allow recreational cannabis dispensaries. The Texas Compassionate Use Program permits only a small number of state-licensed dispensing organizations to produce and distribute low-THC cannabis oil. Bellaire's zoning ordinance does not include provisions for cannabis retail establishments, and no dispensaries operate within the city.
Texas has not legalized recreational marijuana, and there is no framework for retail cannabis dispensaries in the state. The Texas Compassionate Use Act (SB 339, 2015, expanded by HB 1535 in 2021) created a tightly regulated system with a limited number of licensed dispensing organizations authorized to cultivate, process, and dispense low-THC cannabis oil (up to 1% THC) to qualifying patients. As of the current program, only three licensed dispensing organizations operate statewide, none located in Bellaire. These organizations are licensed directly by the Texas Department of Public Safety and their locations are not subject to local zoning approval, though they must comply with all applicable state and local regulations. Bellaire's zoning ordinance in Chapter 24 does not include cannabis dispensaries as a permitted, conditional, or special use in any zoning district. Any future changes to state law permitting broader cannabis sales would require corresponding amendments to the city's zoning ordinance to establish where such businesses could operate. CBD products derived from hemp containing less than 0.3% THC are legal under the federal Farm Bill and Texas HB 1325 (2019) and may be sold by existing retail establishments in Bellaire.
Operating an unlicensed cannabis dispensary is a felony under Texas law with severe criminal penalties including imprisonment and fines. Even possession with intent to distribute carries felony charges. CBD retailers must ensure products contain less than 0.3% THC to avoid criminal liability.
