Cherry Hill, NJ Cannabis Regulations: Dispensary Zoning (2026)

Adopted July 26, 2021 by Ordinance No. L. 2021, c. 16, Township Code § 5-17 exercises the local opt-out authority the state law gives every municipality. It bars all classes of cannabis establishments, cannabis distributors, and cannabis delivery services as those terms are defined in Section 3 of the state act, meaning Cherry Hill Township, Camden County, New Jersey has no zone anywhere in the Township where a cultivator, manufacturer, wholesaler, distributor, retailer, or on-site cannabis dispensary may lawfully locate. Because the prohibition is total rather than confined to specific zoning districts, none of the Chapter 40 zoning districts, including the business and office zones along Route 70 and Route 38, carve out cannabis retail as a permitted or conditional use.

The single exception written into the ordinance is delivery: a licensed cannabis delivery service may still deliver cannabis items and related supplies to Cherry Hill addresses even though no cannabis business may operate a storefront, cultivation site, or distribution facility within Township limits. That distinction tracks the state law's own delivery carve-out, under which municipalities cannot block deliveries originating from a business licensed elsewhere in New Jersey even after banning every other cannabis business class locally. It is a siting ban paired with a delivery pass-through, and any zoning application for a cannabis storefront or grow facility in Cherry Hill would be rejected on this section alone rather than reaching a bulk-requirements review under Chapter 40.
