DuPage County, IL Cannabis Regulations: Dispensary Zoning (2026)

DuPage County adopted its Cannabis Prohibition Ordinance, codified as Chapter 38, in October 2019 under Ordinance No. CB-O-0072-19, shortly after the state's Cannabis Regulation and Tax Act legalized adult-use cannabis statewide. Section 38-201 lists what is barred: adult-use cannabis craft grower, adult-use cannabis cultivation center, adult-use cannabis dispensing organization, adult-use cannabis infuser organization, adult-use cannabis processing organization, adult-use cannabis transporting organization or transporter, and any cannabis lounge, club, or similar facility, open to the public or private, where cannabis may be smoked or cannabis infused materials may be used.

The prohibition reaches every unincorporated parcel; there is no zoning district, conditional use path, or variance under Chapter 38 that opens the door to a recreational dispensary or grow operation. The ban carves out one exception by cross-reference: Section 38-201 states that cannabis business establishments do not include medical cannabis cultivation centers or medical cannabis dispensing organizations as set forth in Section 37-426, so the County's separate medical cannabis program, with its own distance buffers, keeps operating even though recreational sales stay off-limits. Section 38-300 goes a step further and declares operation of any prohibited establishment a public nuisance subject to abatement in addition to prosecution.

Residents in incorporated cities such as Naperville or Wheaton fall under those cities' own cannabis rules rather than Chapter 38, since County zoning and licensing authority reaches only unincorporated DuPage County.
