Under New Jersey's CREAMMA, municipalities had until August 2021 to opt out of allowing cannabis businesses. The vast majority of Bergen County's 70 towns opted out, citing community concerns or political opposition. Towns that opted in or remained in by default include Lodi, Maywood, Rochelle Park, and a small handful of others, each with its own zoning rules limiting dispensaries to specific commercial or industrial zones with school and daycare buffers (typically 200 to 1,000 feet). Bergen County itself imposes no countywide zoning overlay. The state Cannabis Regulatory Commission must approve any dispensary license, with municipal endorsement required.
Operating without licenses or violating zoning brings state license revocation plus fines of $10,000 or more per violation.
