Kenai Peninsula Borough, AK Cannabis Regulations: Dispensary Zoning (2026)

Outside Kenai, Soldotna, Homer, Seward, Seldovia and Kachemak, the borough assembly is the local regulatory authority for marijuana establishments under AS 17.38 (KPB 7.20.010.A), and KPB 7.30.020 sets the siting and operating standards a retail marijuana store, cultivation facility, product manufacturing facility, or testing facility must meet before the assembly sends a non-objection letter to the State Marijuana Control Board. A marijuana establishment cannot sit within 1,000 feet of a school, measured by the shortest pedestrian route from the building's public entrance to the school's outer parcel boundary, within 500 feet of a recreation or youth center, a church, or a correctional facility, or anywhere inside an adopted local option zoning district (LOZD).

Separately, the C-3 Mixed Use LOZD's own use table at KPB 21.44.190.D prohibits marijuana establishments outright within that district, alongside alcohol premises and sexually oriented businesses. A qualifying site needs at least 24 feet of approach width onto a borough right-of-way (except limited cultivation facilities), no on-site parking that spills into the right-of-way, and a marked delivery-vehicle turning route. Retail stores may not open to consumers between 2:00 a.m. and 8:00 a.m. Before the assembly acts, the planning department prepares a staff report addressing the KPB 7.30.020 standards and the assembly holds a public hearing; renewals and transfers instead go to the finance and planning departments for a compliance check under KPB 7.30.010(D).

Every establishment must also hold a current AS 17.38/3 AAC 306 state license, a state business license under AS 43.70.020, and a KPB 5.18.300 certificate of registration, and must stay current on borough tax obligations to avoid an assembly protest to the State Marijuana Control Board.
