Mission Viejo, CA Cannabis Regulations: Dispensary Zoning (2026)

Chapter 11.23A (medical) and the parallel Chapter 11.23B (recreational), both adopted by Ordinance Nos. 16-316 and 16-315 on October 25, 2016, use nearly identical language to opt Mission Viejo entirely out of licensed commercial cannabis. Section 11.23A.004(a) states: "The establishment or operation of any marijuana business is prohibited anywhere in the city. No use permit, building permit, variance, or any other permit or entitlement, whether administrative or discretionary, shall be approved or issued for the establishment or operation of any such business or operation." Subsection (b) reaches beyond brick-and-mortar dispensaries to bar any commercial marijuana activity, including delivery of marijuana or marijuana products to any location within the city, regardless of where the marijuana business is located. Section 11.23B.004 repeats both bans for recreational marijuana businesses licensed under Proposition 64.

The chapters also restrict personal cultivation rather than just commerce: outdoor growing is banned in every zoning district under §§ 11.23A.003(b)/11.23B.003(b), and indoor cultivation by a resident "authorized grower" is capped at 50 square feet, ten feet in height, no more than six plants, and 1,200 watts of lighting, fully enclosed and invisible from the public right-of-way, under §§ 11.23A.003(c)/11.23B.003(c). Section 11.23A.005/11.23B.005 declares any violation a public nuisance subject to abatement, and § 11.23A.006/11.23B.006 confirms the city won't issue any state-required MMRSA or AUMA license, while preserving the CUA/MMPA defense to criminal prosecution for qualifying personal medical use.
