26200. (a) (1) Except as set forth in the Medicinal Cannabis Patients’ Right of Access Act (Chapter 26 (commencing with Section 26320)), this division shall not be interpreted to supersede or limit the authority of a local jurisdiction to adopt and enforce local ordinances to regulate businesses licensed under this division, including, but not limited to, local zoning and land use requirements, business license requirements, and requirements related to reducing exposure to secondhand smoke, or to completely prohibit the establishment or operation of one or more types of businesses licensed under this division within the local jurisdiction. (2) Except as set forth in the Medicinal Cannabis Patients’ Right of Access Act (Chapter 26 (commencing with Section 26320)), this division shall not be interpreted to supersede or limit existing local authority for law enforcement activity, enforcement of local zoning requirements or local ordinances, or enforcement of local license, permit, or other authorization requirements. Full Breakdown

Voters statewide legalized adult-use cannabis through Proposition 64 in 2016, but the law expressly preserved each city's right to ban commercial activity. Anaheim adopted a comprehensive ban that excludes every cannabis license type from any zoning district within the city. No storefront dispensaries, delivery hubs, cultivation facilities, manufacturers, distributors, or testing labs may operate. Anaheim also bans outdoor advertising for cannabis businesses. Personal possession of up to one ounce by adults twenty-one or older remains legal under state law, and indoor personal cultivation of up to six plants is also permitted as state law preempts a complete cultivation ban.

Violations & Fines

Operating any unlicensed cannabis business in Anaheim is a misdemeanor and a public nuisance subject to immediate closure, daily civil penalties up to $30,000 under state law, and asset seizure.

Frequently Asked Questions

Can a delivery service deliver to Anaheim?
State law allows licensed delivery into Anaheim from cities that permit it, but no delivery business may be based or stage in Anaheim.
Will Anaheim ever legalize dispensaries?
Any change would require either a city council ordinance amending Title 18 or a successful citizen ballot initiative; none has passed to date.
