The article is enacted under the New York State Constitution, Municipal Home Rule Law § 10, and Cannabis Law § 131, the state provision that lets a city, town, or village opt out of allowing licensed adult-use retail dispensaries or on-site consumption sites by local law adopted by December 31, 2021, or thereafter subject to a permissive referendum.

Section 35-5 confirms the opt-out here was subject to permissive referendum before it could take effect and be filed with the New York Department of State; an editor's note in the code records that no valid petition for a referendum was ever filed, so the opt-out took effect on its own terms. Section 35-4 includes a standard severability clause preserving the remainder of the article if any part is struck down.
