Parker, CO Cannabis Regulations: Dispensary Zoning (2026)

Parker Municipal Code Chapter 13.07 opts the Town out of the marijuana industry entirely, using authority the Colorado Constitution gives home rule municipalities. Section 13.07.010(c) makes it unlawful for anyone to operate a medical marijuana center, an optional premises cultivation operation, or a medical marijuana-infused products manufacturing facility anywhere in the Town, relying on Article XVIII, Section 14 of the Colorado Constitution and the state Medical Marijuana Code. Section 13.07.020(c) extends the same ban to the retail side under Amendment 64: marijuana cultivation facilities, product manufacturing facilities, testing facilities, and retail marijuana stores are all prohibited in any location within the Town, citing Article XVIII, Section 16 of the Colorado Constitution.

The Town Council's stated finding behind both bans is that no suitable location exists within Parker's corporate limits for these land uses given their secondary impacts on health, safety, and welfare. The ordinance does carve out one narrow exception: § 13.07.010(d) preserves the constitutional right of registered patients and their primary caregivers to use and be provided medical marijuana personally, since that right comes directly from the Colorado Constitution and cannot be zoned away. Under § 13.07.020(f), the Town Clerk is designated as the point of contact for any inquiry about retail marijuana licensing, though the answer to any such inquiry remains that the use is not permitted anywhere in Parker.
