Section 13.08.090(n)(2) of the Parker Municipal Code sets the trigger for when a fence or wall needs a Building Permit. A permit is required for any freestanding fence or wall taller than six feet, matching the maximum height allowed outright in most residential and Public/Institutional/Civic/Commercial zones, and for any retaining wall taller than four feet, since those structures raise separate structural safety concerns addressed in Section 13.08.090(n)(6). The permit requirement is triggered by height alone, not by location, so a fence approved for an industrial lot under Section 13.08.090(n)(3)b, which can reach eight or even twelve feet with Planning Director approval, needs a Building Permit for the portion above six feet regardless of the underlying zoning district.

Because the LDO applies fence and wall standards, including materials, design, and setback rules, to every zoning district unless a buffering or screening section requires different treatment, obtaining the permit also means the applicant must show the finished project meets Section 13.08.090(n)'s height, corner-lot sight, and material standards, plus any Building Code structural requirements Community Development's permit reviewers apply. A shorter, code-compliant residential fence, six feet or under and outside the front-yard 42-inch zone, is exempt from the permit step itself but is not exempt from the underlying height, material, and design rules, which the Town can still enforce through code inspection.
