Safety Harbor allows licensed Medical Marijuana Treatment Centers wherever pharmacies are permitted, and processing or growing in M-1 Light Industrial. Florida law sets the same regulatory framework as pharmacies.
After a moratorium ending in 2017, the City Commission directed staff to draft an ordinance permitting MMTC dispensing facilities as a use anywhere retail pharmacies are allowed under the Land Development Code. Processing and indoor growing facilities are limited to the M-1 Light Industrial district, with outdoor cultivation only on agricultural conditional-use sites such as the former Sun Groves citrus center. Florida Statute 381.986 requires cities to either treat MMTCs identically to pharmacies or ban them outright; Safety Harbor chose to permit them under pharmacy standards. Dispensaries must maintain a 500-foot buffer from public schools per state law.
Operating without state MMTC license or outside permitted zoning is enforced by both DBPR and city zoning. Penalties include closure orders and fines.
