Summary

Southborough prohibits the operation of any marijuana establishment in all zoning districts under § 53-1, with an exception for medical marijuana licensed under Chapter 369 of the Acts of 2012 and currently permitted. A registered medical dispensary needs a Board of Appeals special permit under § 174-9J and a lot on Route 9 in one of three districts.

(a)  The Board of Appeals as special permit granting authority may grant a special permit for a registered marijuana dispensary only in the Highway Business District [as identified in § 174-8.5C(14)] , Industrial Park District [as identified in § 174-8.6C(15)] , or Industrial District [as identified in § 174-8.7C(14)] , and only upon compliance with the following requirements: ... [3]  A registered marijuana dispensary and/or cultivation activities shall only be located i) on property that borders Route 9, and ii) not less than 1,000 linear feet from a property line of a school, recreational facility or day-care center, or any facility in which children commonly congregate [see definitions in § 174-9J(2)(c) below] located in the Town of Southborough, and iii) not less than 100 linear feet from a property line of a residence located in the Town of Southborough. The required distances shall be measured from all property lines of the proposed facility.

Full Breakdown

Chapter 53, adopted by Town Meeting on 4-25-2017 (Annual Town Meeting, Art. 31), is a flat prohibition. The operation of any marijuana establishment as defined in MGL c. 94C, § 1, including a marijuana cultivator, marijuana testing facility, marijuana product manufacturer, marijuana retailer or any other type of licensed marijuana facility, is prohibited in all zoning districts of the Town. The prohibition does not apply to the sale, distribution or cultivation of marijuana for medical purposes, licensed under Chapter 369 of the Acts of 2012 and currently permitted in the Town. The zoning bylaw repeats the same sentence in many of the district sections of Chapter 174.

Medical dispensaries are handled by § 174-9J. Subsection (1)(b) provides that the cultivation, production, processing, assembly, packaging, retail or wholesale sale, trade, distribution or dispensing of marijuana for medical use is prohibited unless permitted under that section. Under subsection (2)(a), the Board of Appeals acts as special permit granting authority and can grant a special permit for a registered marijuana dispensary only in the Highway Business District, the Industrial Park District or the Industrial District.

The location tests are specific. The property must border Route 9. It must be not less than 1,000 linear feet from a property line of a school, recreational facility or day-care center, or any facility in which children commonly congregate, and not less than 100 linear feet from a property line of a residence in Southborough. Distances are measured from all property lines of the proposed facility. The section defines SCHOOL as any public or private educational facility that provides services to children in grades 12 or under, and DAY-CARE CENTER as an establishment licensed by the Massachusetts Department of Early Education and Care.

Other conditions include a written consent to a criminal background check that includes jurisdictions beyond Massachusetts, compliance with the Town's Sign Bylaw (§ 174-11), and a ban on off-site signage or advertising in any form. No activities, products or treatment inside can be displayed in the windows or be visible to the public. A special permit is valid for two years from issuance, and a renewal is governed by the standards and procedures then in the bylaw.

Violations & Fines

Section 53-1 prints no fine of its own. Operating outside the § 174-9J framework means running a use the Town prohibits. A permitted dispensary that uses misleading, deceptive, false or minor-oriented advertising does so upon penalty of special permit revocation under § 174-9J(2)(a)[4]. Each special permit is valid for two years, and § 174-9J(2)(b) gives no entitlement or vested right based on any prior permit.

Frequently Asked Questions

Can a recreational marijuana store open in Southborough?
No. Section 53-1 prohibits the operation of any marijuana establishment, including a marijuana cultivator, testing facility, product manufacturer or retailer, in all zoning districts of the Town. The only exception covers the sale, distribution or cultivation of marijuana for medical purposes, licensed under Chapter 369 of the Acts of 2012 and currently permitted in Southborough.
Where can a registered medical marijuana dispensary locate in Southborough?
Only in the Highway Business District, the Industrial Park District or the Industrial District, and only with a special permit. The property must also border Route 9. Section 174-9J(2)(a) sets these conditions, and the cultivation, production or dispensing of medical marijuana is prohibited unless permitted under that section.
How far must a dispensary be from schools and homes?
Section 174-9J(2)(a)[3] requires a location not less than 1,000 linear feet from a property line of a school, recreational facility or day-care center, or any facility in which children commonly congregate, and not less than 100 linear feet from a property line of a residence. Distances are measured from all property lines of the proposed facility.
Who grants a dispensary special permit and for how long?
The Board of Appeals acts as special permit granting authority under § 174-9J(2)(a). Under § 174-9J(3), a special permit is valid for a period of two years from the date of issuance. A renewal is governed by the then-existing standards and procedures in the bylaw and any regulations adopted by the Board of Appeals.
