Under California Health & Safety Code Section 11362.2 (Proposition 64) and SMMC Chapter 20.400, San Marcos residents 21 and older may cultivate up to 6 living cannabis plants indoors per residence for personal use. Outdoor cultivation of cannabis is prohibited within San Marcos city limits. Indoor grows must be in a fully enclosed, locked space not visible from outside. Plants must not create odors detectable beyond the property boundary. Cultivation must not use volatile solvents for extraction. Grows must comply with all applicable building and electrical codes; no unpermitted electrical modifications. Cultivation within 600 feet of a school, daycare, or youth center may face additional restrictions. Only one cultivation area per residence regardless of number of occupants.
