Under ARS §36-2852, adults 21 and older may cultivate marijuana at their primary residence. The limit is 6 plants per person, with a household maximum of 12 plants if two or more adults reside there. All plants must be grown in a locked, enclosed area not visible from public areas or neighboring properties without the use of binoculars or aircraft. Growing outdoors in an open yard is not permitted. The cultivation area must be reasonably secured from unauthorized access, particularly minors. Home cultivation is for personal use only; selling homegrown marijuana is illegal. Landlords and HOAs may restrict or prohibit cultivation in rental agreements or CC&Rs. Scottsdale does not require a separate municipal permit for home cultivation but property owners must comply with all applicable building codes if making modifications for a grow room (electrical, ventilation, etc.).
Exceeding plant limits, failing to secure the grow area, or selling homegrown marijuana may result in criminal charges. Violations of building codes related to grow room modifications can result in code enforcement action.
