Arizona Proposition 207, approved by voters in November 2020, legalized recreational cannabis for adults 21 and older. Adults may cultivate up to 6 marijuana plants at their primary residence. Households with two or more adults may grow up to 12 plants. All plants must be kept in an enclosed, locked area that is not visible to the public from any public right-of-way. Indoor growing is permitted. Outdoor growing must be in a locked greenhouse or structure. The City of Surprise does not impose additional restrictions beyond state law for home cultivation. However, cultivation that creates nuisance conditions (odor, visible evidence, excessive electricity use) may trigger code enforcement complaints. HOAs may attempt to restrict cultivation through CC&Rs but the enforceability of such restrictions against state-legal activity varies.
Exceeding the plant limit is a criminal offense under Arizona law. Cultivation visible to the public or not in an enclosed, locked area may result in citations.
