California Proposition 64 (2016), codified at Health and Safety Code Section 11362.2, allows persons 21 or older to cultivate up to six living plants per private residence regardless of how many adults live there. Cities can reasonably regulate but not ban indoor personal cultivation. Long Beach permits indoor growing only inside a private residence or fully enclosed accessory structure that is locked, ventilated to prevent odors detectable beyond the property line, and not visible from the public right of way. Outdoor cultivation is prohibited. Renters need landlord written consent, and cultivation cannot use a method that violates building or fire code.
Outdoor cultivation, growing more than six plants, or producing detectable odor at the property line can result in administrative citations, plant abatement, and in commercial-scale cases criminal charges under state law.
