Under California Proposition 64, Stockton residents 21 and older may grow up to six cannabis plants per residence for personal use. Stockton requires indoor cultivation only and prohibits outdoor grows visible from public rights-of-way or accessible to minors.
California Health and Safety Code Section 11362.2 lets adults 21 and older cultivate up to six living cannabis plants per private residence. Cities cannot ban indoor personal cultivation, but they can require it occur inside a locked, secure structure and ban outdoor cultivation entirely. Stockton's commercial cannabis ordinance treats outdoor home grows as a violation, and indoor cultivation must avoid creating odor, mold, or electrical hazards. Plants must be inaccessible to anyone under 21. Cultivation in a rental property requires landlord consent, and HOAs can restrict the practice further within their CC&Rs.
