No swimming pool, spa or hot tub can be built, installed, enlarged or altered in Cape Coral without a building permit from the Department of Community Development under Code § 5-20. Section 5-21 requires the application plans for commercial pools to be prepared by a Florida-licensed engineer, and § 5-26 gives the city authority to inspect any pool at any reasonable hour.
