Milpitas, CA Code Violation Reporting: Response Times (2026)

Milpitas Municipal Code Chapter 21 governs administrative citations issued by any Enforcement Officer designated by the Municipal Code or City Manager. Under Section I-21-1.03(B), a Continuing Violation that does not endanger public health and safety must be given a correction period of not less than 15 days before the City can impose an administrative fine. Where a Continuing Violation or an Individual Violation creates an immediate danger to public health and safety, the property owner instead gets a maximum of two hours from receipt of verbal or written notice to correct it; if the two-hour deadline is missed, the City may initiate summary abatement under Section V-500-3.08 or move straight to the administrative fine and citation process under Section V-500-8.00.

For an Individual Violation that is not an immediate danger, the first offense draws a written notice to correct, but a second or later violation of the same code provision gets no correction opportunity before the fine is imposed. Every citation must state the date and location of the violation, the code section violated, the fine amount, the payment process, an order to stop the violation, and the appeal process, and must be signed by the citing Enforcement Officer. Each day a violation continues counts as a new, separate violation under Section I-21-1.03(D).

Recipients who dispute a citation must file a hearing request within 15 calendar days with an advance deposit of the fine, or a hardship waiver request, per Section I-21-1.05.
