Brevard County unincorporated areas impose a 90-day minimum rental period in most residential zones, effectively prohibiting traditional STRs. This pre-dates the June 1, 2011 Florida preemption and is grandfathered. STRs are only permitted in Resort Dwelling (RD) or similarly approved zones.

STRs operating in permitted zones must comply with Brevard County's general noise ordinance Chapter 46, Article IV. Quiet hours are 10 PM to 7 AM. No STR-specific noise rules exist beyond the general ordinance.
STR operators in Brevard County must collect the 5% Brevard County Tourist Development Tax on accommodations of 6 months or less, 6% Florida state sales tax, and applicable county discretionary surtax. Monthly remittance to the Tax Collector by the 20th.
