Assessment & Dues

When a Jackson County subdivision developer hands an HOA over to its lot owners, Unified Development Code § 1516(e) requires the association to already hold a reserve account of at least $125 per occupied residence for a residential association, or an amount the Public Development Director approves for a nonresidential subdivision. The association may carry no debt at handover.

CC&R Enforcement

In unincorporated Jackson County, a homeowner's association created for a major subdivision must enforce its own declaration and bylaws: Unified Development Code § 1516(f) puts that job with an association management company, not the county. The Public Development Department and county attorney only review and approve the covenants once, at recording; after that, dues and CC&R enforcement is private business, not code enforcement's job.

Board Governance

Unincorporated Jackson County requires a homeowner's or property owner's association whenever a major subdivision includes common areas, open space, or a separate stormwater detention tract. Unified Development Code § 1516 makes membership mandatory for every lot, requires recorded bylaws and covenants, and keeps the county attorney and Public Development Department in the approval loop before the association can be dissolved or its documents recorded.
