Cupertino, CA Curfew Laws: Juvenile Curfew (2026)

m. 020 makes it unlawful for any minor, defined as a person under 18, to remain in a public place during those hours, and separately unlawful for a parent or guardian to knowingly permit or, through insufficient control, allow the minor to do so. Public place is defined broadly to include streets, sidewalks, parks, school common areas, apartment common areas, office buildings, transit facilities and commercial stores. 030 lists nine circumstances where the curfew does not apply: the minor is with a parent or guardian; on a direct errand for a parent or guardian; traveling in interstate commerce; going to or from employment without a detour; responding to an emergency; standing on the sidewalk in front of the minor's own home or a next-door neighbor's home, unless that neighbor has complained to the sheriff's office; attending or traveling directly to or from a school, religious or supervised recreational activity; exercising constitutionally protected speech, assembly or religious rights; or married or emancipated under Family Code Section 7000.

Because Cupertino contracts with the Santa Clara County Sheriff's Office for police services, the sheriff's office is the enforcing agency named in the ordinance's own neighbor exception.
