The ordinance lists nine exceptions: the minor is or has been married, is accompanied by a parent, guardian or legal custodian, is performing a duty directed by a parent or guardian, is engaged in employment or an employment-related activity, is engaged in interstate travel, is attending a supervised school, religious or civic activity, is exercising First Amendment rights, is out because of an emergency, or is on the sidewalk in front of his or her own home or an adjacent home.
It is separately unlawful for a parent, guardian or custodian to knowingly allow a minor to remain out during curfew hours, and unlawful for an establishment owner to permit a minor to stay on the premises during those hours; an owner has a complete defense if the police department was notified about the minor after being asked to leave. Enforcement: any minor detained is delivered to a parent, guardian or custodian, who is informed of the violation. A first violation without aggravating circumstances draws only a warning; a second or subsequent violation, or one with aggravating circumstances, is referred for handling under Wis. chs. 48 and 938, the state juvenile justice and delinquency codes.

A minor caught out past curfew is not fined on a first, non-aggravated offense; the minor instead receives a warning.
