Ontario prohibits minors under 18 from being in public places between 10:00 p.m. and 5:00 a.m. without a parent or qualifying exception under OMC Chapter 6.
Ontario Municipal Code Chapter 6 establishes a juvenile curfew that makes it unlawful for a minor under the age of 18 to loiter, remain, or wander in any public place, public parking lot, or business establishment open to the public between the hours of 10:00 p.m. and 5:00 a.m. Exceptions include minors accompanied by a parent or legal guardian, minors on an errand directed by a parent, minors returning home directly from a school, religious, or civic activity, minors engaged in lawful employment, and minors who are emancipated under California Family Code 7050. The curfew also contains a daytime provision that prohibits truancy-aged minors from being in public places during school hours under California Education Code 48260 when a student is absent without a valid excuse. Violations are infractions punishable by fines up to 250 dollars under OMC, and repeat offenders can be referred to San Bernardino County Probation. Parents who knowingly permit curfew violations may also be cited for contributing.
