Sec. 1 sets two curfew tiers. the following day. m. A parent or guardian who knowingly permits, or through insufficient control allows, either violation is separately liable, as is a parent, guardian, or custodian who refuses to take custody of the minor when a police officer demands it after an arrest. Each violation is a distinct offense, and an adult convicted under the section is guilty of a class 1 misdemeanor; for the minor, the same conduct is classified as an incorrigible offense under juvenile court jurisdiction (Sec.

1). Sec. 2 lists specific defenses: being accompanied by a parent or guardian, traveling interstate with prior parental permission, commuting directly to or from work, responding to an emergency, engaged with prior permission in a specific lawful business or activity, exercising First Amendment rights with prior permission, being married and sixteen or older or in the military, or standing on the sidewalk abutting the family home or a consenting neighbor's property. Before enforcing, Sec. 3 requires an officer to first try to determine the apparent offender's age and reason for being out, and bars a citation or arrest unless the officer reasonably believes an offense occurred and no defense is probably present.

Officers who arrest a minor may demand a parent or guardian retrieve the minor, take the minor to a location for pickup, or take the minor home if no one responds.
