" The Town does not fix one town-wide curfew in the code itself; each park carries its own posted hours set administratively, and those signs are what a patron is legally bound to follow. Related § 137-8(C) ties vehicle parking to the same clock: a car left standing in a recreation area outside the hours use is permitted triggers a presumption against the vehicle's registered owner in any enforcement action. Section 137-9(D) separately requires every patron to obey the lawful direction or command of the Colonie Police Department, Parks and Recreation Department staff, or any posted instruction, warning or prohibition, so ignoring a closing sign is independently punishable on its own terms.

Enforcement runs through both the Colonie Police Department and the Parks and Recreation Department under § 137-32, and a violation is punishable under § 137-31(B) by a fine up to $250 or up to 15 days in jail, or both, with each day of a continuing violation treated as a separate offense under § 137-31(B) and (D). The Parks and Recreation Department may also revoke a violator's park privileges under § 137-31(A) and (C), without any refund of fees already paid. Anyone disciplined under this chapter can appeal to the Parks and Recreation Appeals Board, a three-to-five-member resident panel appointed by the Town Supervisor with Town Board approval, created by § 137-33.
