Every park, including Malone Park after its later hour, remains closed from that time until sunrise the next morning, and the code states plainly that no person shall remain in a park during the closed hours. The closure rule carries built-in flexibility for the Commission: it does not apply to vehicular traffic passing through a park on a street or roadway, and the Commission can publish general permission to use some or all parks on summer nights, or make exceptions for scheduled sports leagues and community events.

The Commission also retains authority to post different closing hours for any specific park, or discontinue closing hours altogether, whenever it judges that reasonable and necessary, so postings at individual parks control over the default dusk closing where they exist. Section 184-3(B) gives the Commission a separate emergency power to close all or part of a park to the public, or to specific people, whenever an emergency or the public interest demands it, until permission to return is given. The park-hours rule sits in the same section as several other after-hours prohibitions covering alcohol, glass containers, disorderly conduct, smoking and loud radios inside parks, each carrying its own citation amount.
