Rochester Hills, MI Curfew Laws: Park Curfew (2026)

Section 74-61, in Article II, Division 2 ('Rules and Regulations') of the parks chapter, does not print a single fixed curfew for every park; instead it directs the city council to establish hours of operation for each park individually by resolution. Copies of those hour-setting resolutions, like the resolutions designating park boundaries under section 74-28, are kept on file for public inspection at the city clerk's office. The section then makes the rule enforceable directly: no person shall enter or remain within a park at any time other than its established hours, unless the mayor has extended those hours for a special event.

Section 74-62 gives the mayor a separate, broader closure power: the mayor may declare an entire park, or any portion of one, closed to public use or entry at any time, and while that closure is in effect, no one may enter or remain in the closed area except someone whose presence relates to a municipal activity, a project, or an activity the city has licensed to occur there. Section 74-30 backs both provisions with emergency authority, letting the mayor establish emergency rules to protect park visitors, property and order whenever needed.

Enforcement runs through section 74-29: designated city employees or agents, and any officer named under section 1-14, secure and police the parks, and interfering with or impersonating one of those officers is itself a separate offense. Because Division 2 sets no fine of its own for an hours or closed-area violation, section 1-16's general penalty controls.
