Stockton Municipal Code §12.56.020 closes city parks from one hour after sundown to one hour before sunrise; lighted recreation areas (tennis courts, ball fields) close at 10:00 p.m. and reopen at 6:00 a.m. Entering, remaining, or loitering in a closed park is an infraction.
Under Stockton Municipal Code §12.56.020, it is unlawful for any person to enter, remain, or loiter within the limits of any park owned by the City between one hour after sundown and one hour before sunrise the next day. The time provisions do not apply to those places in each park designated as lighted recreation areas (such as tennis courts and ball fields), but in no event shall a person remain in any lighted recreation area in such park after 10:00 p.m. nor enter such park before 6:00 a.m. unless written permission is received from the Department of Parks and Recreation. The provisions do not apply unless the park has been posted as provided in §12.56.030 — Stockton Parks and Recreation maintains posted signs at every city-managed park (Weber Point, Victory Park, Oak Park, Louis Park, McKinley Park, and others) showing the closure window. The chapter does not apply to peace officers or other duly authorized public employees in the course of duty. The park curfew operates as a general curfew that applies to all ages (not only minors); juveniles in parks after closure are also subject to SMC Ch. 9.24 (Juvenile Curfew Regulations). Combined enforcement allows Stockton PD to address late-night gatherings under either or both ordinances. The chapter is enforceable as a public-nuisance abatement tool under Cal. Civil Code §3479 and Cal. Govt. Code §38771 (city authority to declare nuisances).
Violation of SMC §12.56.020 is an infraction under SMC §1.24 — first offense up to $100, second offense within one year up to $200, third offense up to $500. Repeated or willful violations may be charged as a misdemeanor (up to 6 months jail / $1,000 fine). Vehicles parked in a closed park may be cited and/or towed under SMC Title 10 (Vehicles and Traffic).
