All city parks are open for public use from daylight to 10:00 p.m., with the exceptions of Kidtopia and Bringle Lake East which are open for public use during daylight hours only. The parks shall be open to the public every day of the year unless closed at the direction of the parks and recreation director due to unusual or emergency circumstances. It shall be unlawful for any person to use or be in a city park during hours other than those listed herein as open for public use. It shall be a defense to prosecution of this offense if the person was a participant or spectator at a scheduled special event or sporting event, including a baseball, softball or soccer game.
