Nothing in Harlingen's code names a data center, and no zoning performance standard sets an emission figure for one. A colocation or hyperscale facility here is therefore treated as an ordinary commercial establishment under the general noise ordinance, and the answer for any given site turns almost entirely on which zoning district it sits in.

The test in § 34-114(e)(2) has three parts that all have to be met before a complaint stands. The noise must be unreasonably loud and raucous, it must come from the premises of a commercial establishment, and it must be plainly audible at a distance of five feet from any residential property. There is no decibel figure anywhere in the provision, so a Harlingen chiller bank or standby generator is judged by what an officer can hear standing at that five foot line, not by a meter reading against a numeric cap. The prohibition also applies only between 10:00 p.m. and 7:00 a.m.; outside those overnight hours the subsection does not reach the noise at all.

Subsection (f)(13) is what decides most data center questions in Harlingen. It exempts properties located within an industrial zone or industrial land uses from the prohibitions set out above, with no time limit and no qualifying condition. A data center built on industrially zoned Harlingen land is outside § 34-114 entirely, which means neither the 10:00 p.m. to 7:00 a.m. window nor the five foot audibility test applies to it even where homes sit nearby. The exemption keys on the property, and separately on the land use, so the analysis starts with the parcel's district rather than with the equipment.

That leaves a narrow band of exposure. A data center on land that is not industrially zoned and is not an industrial land use is a commercial establishment for purposes of subsection (e)(2) and can be cited on the audibility standard during the restricted hours. Because the standard is qualitative, a complaint in Harlingen is built on an officer's or code enforcement observation rather than on instrument readings.
