Florida's Unmanned Aircraft Systems Act (FL Statute 934.50, amended by HB 1027 in 2017) preempts local governments from enacting most drone regulations, reserving authority to the state legislature. However, Miami Beach restricts drone operations on city-owned property, parks, and beaches under its general property management authority. The city does not issue permits for recreational drone use. Much of Miami Beach falls within controlled airspace near Miami International Airport (MIA) and Opa-locka Executive Airport, requiring FAA authorization via the LAANC system before flying. Recreational drone operators must follow FAA rules: fly below 400 feet, maintain visual line of sight, yield to manned aircraft, and stay away from emergency response operations.
