In York County, Virginia, a private or club marina, dock, or boathouse falls under Code § 24.1-463, which limits the use of these facilities to a defined membership and bars them from serving the general public or operating for commercial purposes; that separates them from the commercial marina standards in § 24.1-462. Before the county issues a zoning certificate for a dock, pier, or boathouse, the applicant must show that every applicable federal, state, and local requirement for marina facilities has been met, and the necessary permits actually obtained; this means Virginia Marine Resources Commission design approval and any wetlands or Chesapeake Bay Preservation Area permits have to be secured up front, since York County borders the York River and its tributaries.

A private or club marina that wants a restaurant on-site must meet the same detailed restaurant standards that apply to commercial marinas under § 24.1-462(c), covering setbacks from residential structures, hours of patron admission, and noise limits under § 16-19 of the County Code. Any private or club facility built to serve vessels carrying more than four hundred passengers, or the tender vessels that service them, must also meet the commercial-marina special use permit standards in § 24.1-462(d), including a traffic impact analysis and Planning Commission and Board of Supervisors review.
