Summary
Before Carlsbad will grant final approval on a building permit, Municipal Code Section 17.06.020 requires the property to already meet defensible-space vegetation management standards under Fire Code Section 603 and state law, Public Resources Code Section 4291 or Government Code Section 51182, verified by the fire authority, a third-party inspector, or an owner certification the city accepts.
California WUI Code, Chapter 1, Scope and Administration, is adopted in its entirety with the following amendment: Chapter 1, Part 2, Section 106, Construction Documents, is amended to read: 106.4 Vegetation management compliance. Prior to the building permit final approval, the property shall be in compliance with the vegetation management requirements prescribed in Section 603, including California Public Resources Code 4291 or California Government Code Section 51182 and or other applicable codes and regulations adopted by the jurisdiction. Acceptance methods of compliance inspection and documentation shall be determined by the enforcing agency and shall be permitted to include any of the following: A. Local, state or federal fire authority or designee authorized to enforce vegetation management requirements. B. Enforcing agency. C. Third-party inspection and certification authorized to enforce vegetation management requirements. D. Property owner certification authorized by the enforcing agency.

Full Breakdown
020). 4, tying building permit final approval directly to vegetation-management compliance and naming four acceptable ways to document it: certification by a local, state, or federal fire authority; the city's own enforcing agency; an authorized third-party inspector; or the property owner, if the enforcing agency authorizes owner certification. 1 to require landscape and fuel-modification plans to delineate 5-foot, 30-foot, and 100-foot fuel management zones measured from every structure, identify existing and proposed vegetation with a botanical and common-name plant legend, mark irrigated areas, and show ground coverings within the 5-foot and 30-foot zones.
1 to require continuous maintenance of that clearance, with all approved fire protection, landscape, and fuel modification plans subject to the WUI Code's Section 109 enforcement process or a notice served on the property owner or the owner's agent.
Violations & Fines
A property that hasn't documented compliance can't get final sign-off: Section 17.06.020 conditions building permit final approval on proof of vegetation-management compliance, and Section 17.06.070 subjects landscape and fuel-modification plans to the enforcement process in WUI Code Section 109 or a notice served on the owner or the owner's agent. Fire Code enforcement citywide under Section 17.04.020(B) additionally makes a code violation a misdemeanor punishable by up to $1,000 and six months in jail.
