Porterville, CA Environmental Rules: Defensible Space (2026)

Article 501's section 501.10(J), 'Fuel Modification Zones,' governs hillside parcels adjacent or exposed to hazardous fire areas. Subsection 1 requires a permanent fuel modification area and fire prevention plan around the development, with the fire chief determining the recommended width based on the applicable building and fire codes, the state wildland-urban interface standards for state responsibility areas, and five listed factors: the natural, nongraded slope of the project and adjacent land; fuel loading; access for fire suppression equipment into the modified area and evacuation egress out of the project; on-site water availability for firefighting, including flow, pressure and duration; and the 'built-in' fire protection features of the structures themselves.

Subsection 2 makes the zone a continuing obligation, not a one-time landscaping step: the fire chief may require brush, vegetation or debris in the fuel modification area to be removed and cleared, and that maintenance duty is enforced consistent with section 12-1.1 of the municipal code, which adopts the 2025 California Fire Code as the City of Porterville's fire code. A violation of the Fire Code adopted at section 12-1.1, including a failure to clear a required fuel modification zone, is punishable under section 12-1.10 as a misdemeanor carrying a fine of up to five hundred dollars, up to six months in the city or county jail, or both, and the City may instead pursue an administrative citation under Chapter 2, Article 14 of the Porterville City Code. These fuel modification requirements apply only within the mapped Hillside Zone (HZ) Overlay District reviewed under a hillside development permit.
