Bellevue, NE Environmental Rules: Erosion Control (2026)

Section 27.5-101 of the Bellevue Code makes it unlawful to engage in grading, cleaning or excavation activities without a grading permit issued by the Permits and Inspections Department, and specifically bars grading, clearing or excavation that disturbs land or soil sufficiently to require a general NPDES construction site stormwater permit unless the property owner, tenant, easement holder or their agent first gets that grading permit; the section exempts grading performed solely for agricultural purposes. Section 27.5-102 requires the applicant to submit a completed NDEQ notice of intent for coverage under the general NPDES construction stormwater permit along with the city application, and the city reviews the paperwork and forwards it, with its recommendation, to the Nebraska Department of Environment and Energy (NDEQ) for approval.

Section 27.5-103 sets the grading permit fee at $750.00 for a site of ten acres or less, and $1,250.00 for anything larger. Section 27.5-104 directs the Permits and Inspections Department to issue the grading permit once the director determines the plan meets the chapter's requirements and either NDEQ has approved the NPDES application or has not acted within seven days. Section 27.5-105 then governs the actual erosion and sediment control work: it states that erosion and sediment control provisions for construction and development sites, both inside the city limits and in the city's jurisdictional area outside them, are set out in the Omaha Regional Stormwater Design Manual, which controls all such construction and development activity, and that where the Manual, another law, or an NPDES permit conflict, the most stringent or specific practice governs.
