A vehicle that has lost its identity, character, utility or serviceability triggers the nuisance declaration in § 19-40, which the city can act on once it is found on any lot in the city's zoning jurisdiction. Section 19-41's seven-day clock runs from the point a vehicle becomes a declared nuisance, and the only carve-outs are a vehicle kept fully inside an enclosed building, or one on a business's premises zoned ML Light Manufacturing or MH Heavy Manufacturing when necessary to the lawful operation of that business.

For any other lot, § 19-42 requires the city to deliver an Official Notice by personal service or mail and post it on the property; the owner then has five business days to request an impartial hearing before the Chief of Police or a designee, and must pay a $35.00 fee with the hearing request. If the applicant does not request or attend the hearing, or loses it, § 19-42 gives seven business days after that decision to remove the vehicle before the city removes it and bills the reasonable costs.

Unpaid removal costs can be assessed against the lot like a special tax under § 19-43(A), or the city may instead sell the vehicle at public auction five days after removal and apply the proceeds to the auction and storage costs, with any owner who claims the vehicle before the sale still owing those costs.
