Projects disturbing one acre or more require an FDEP NPDES Generic Permit for Stormwater Discharge from Construction Activities with a Stormwater Pollution Prevention Plan (SWPPP) that details all erosion and sediment control measures, inspection schedules, and responsible parties. BMPs must be inspected at least every seven days and within 24 hours of any rainfall event of 0.5 inches or more. Disturbed areas must be temporarily stabilized within 14 days of the last construction activity or permanently stabilized with sod or other ground cover upon project completion. Dewatering operations must filter or settle sediment before discharge. North Miami's flat topography and high water table mean that dewatering is frequently necessary and must comply with FDEP dewatering permit requirements. Construction debris and sediment that enters the stormwater system must be removed immediately.
Failure to maintain erosion controls may result in stop-work orders and Code Enforcement fines starting at $250 per day. FDEP may impose penalties up to $10,000 per day for NPDES permit violations. Sediment discharge to Biscayne Bay may trigger additional Miami-Dade DERM enforcement.
