Under Chapter 46, Article X of the Miami Beach Municipal Code and the city's NPDES co-permit with Miami-Dade County, all construction activities involving soil disturbance including clearing, grading, and excavation must implement erosion and sediment controls. Mandatory Best Management Practices (BMPs) include temporary gravel construction entrances and exits, storm drain inlet protection, silt fencing, and floating turbidity barriers for any waterfront construction. BMPs must be inspected and approved by the Environment and Sustainability Department director prior to the first mandatory Florida Building Code inspection. A Sediment and Erosion Control Affidavit must be submitted with permit applications. Contractors must maintain BMPs throughout construction and repair or replace damaged controls within 24 hours. Dewatering activities require separate approval and turbidity monitoring to protect Biscayne Bay water quality. Post-construction stormwater management measures must be in place before the certificate of occupancy is issued.
Failure to maintain erosion and sediment controls may result in fines and penalties under Chapter 46, Article X. NPDES violations can trigger EPA or Florida DEP enforcement with fines up to $25,000 per day. Stop-work orders may be issued for sites without proper BMPs.
