Volusia County LDC and Code Ch. 82 require erosion and sediment control plans for grading, clearing, and construction activities. Required BMPs include silt fences along downslope perimeters, stabilized construction entrances with crushed stone, inlet protection on storm drains, sediment traps/basins for larger sites, and temporary seeding or mulching of stockpiles. Missing or failed BMPs: stop-work order and fines $250-$2,500 per violation. Sediment discharge to wetlands or OFW: FDEP fines $1,000-$25,000 per day under F.S. §403.121. Failure to file SWPPP/NOI: EPA and FDEP joint enforcement possible. Repeat violations: criminal referral.
