Volusia County LDC and Code Ch. 82 require erosion and sediment control plans for grading, clearing, and construction activities. Projects disturbing 1 acre or more must file a Notice of Intent under the FDEP NPDES Construction Generic Permit (CGP) per F.S. Ch. 403 and 62-621 F.A.C. Required BMPs include silt fences along downslope perimeters, stabilized construction entrances with crushed stone, inlet protection on storm drains, sediment traps/basins for larger sites, and temporary seeding or mulching of stockpiles. A Stormwater Pollution Prevention Plan (SWPPP) must be kept on-site. Inspections required after every storm event of 0.5 inch or greater. Disturbed areas must be stabilized within 14 days of final grade. Coastal project areas near the Atlantic beach require enhanced controls to protect sea turtle habitat and Outstanding Florida Waters designations.
Missing or failed BMPs: stop-work order and fines $250-$2,500 per violation. Sediment discharge to wetlands or OFW: FDEP fines $1,000-$25,000 per day under F.S. Β§403.121. Failure to file SWPPP/NOI: EPA and FDEP joint enforcement possible. Repeat violations: criminal referral.
