Deltona, FL Noise Ordinances: Amplified Music & Outdoor Sound (2026)

Section 38-74 of the Deltona Code regulates loudspeakers and public address systems used to produce sound signals from any source. The phrase "for either advertising or other purposes" makes the rule broad. It covers a business promoting itself and also non-advertising uses such as announcements or amplified music at an event.

Where it applies. The section covers systems operated on or over public property and public rights-of-way. The words "on or over" reach sound equipment positioned above public property as well as equipment set up on it. The quoted text concerns public property and rights-of-way in Deltona and does not address a speaker used on private property.

License. These systems may not be operated unless a license has been issued by the officer designated in Deltona's noise article. Operating first and applying later does not satisfy the section, because the license must already have been issued.

Fee. A fee must be paid for the license. The amount is not stated in Sec. 38-74 itself. It is established by resolution of the city commission and appears in the appendix A fee schedule.

Days and hours. Even with a license, such systems may be used Monday through Saturday during daylight hours only. That wording sets a limit on days and a limit on hours. Sunday is excluded entirely, so there is no licensed loudspeaker use on Deltona public property on Sundays. Use is also confined to daylight hours, which rules out operation after dark on the permitted days. The section gives no clock times, so the limit is daylight itself.

Cancellation. The permit may be canceled for noncompliance with "this article," meaning Deltona's noise article as a whole and not only Sec. 38-74. A license holder who violates another part of the noise article can lose the loudspeaker license.
