ORS 468B.025 prohibits discharging earth, sediment, or other materials into waters of the state without a permit. The 1200-C general permit (OAR 340-045-0033) requires every construction operator on a one-acre or larger site to prepare an Erosion and Sediment Control Plan, install perimeter controls, stabilize disturbed areas within 14 days of inactivity, manage concrete washout, and conduct weekly and post-storm inspections. Sites below one acre that are part of a larger common plan still need coverage. Cities and counties commonly delegate inspection, but DEQ's BMP minimums and water-quality standards remain enforceable directly under state law.
Failing to install required BMPs or causing sediment to reach waters of the state can trigger DEQ civil penalties under ORS 468.140 of up to $25,000 per day plus mandatory cleanup orders.
