Erosion control in St. Joseph County runs through the Construction Stormwater General Permit. Every site disturbing one acre or more must implement a Stormwater Pollution Prevention Plan (SWP3) controlling erosion and sediment before, during, and after construction.
The SWP3 is the heart of CSGP compliance. It sets the erosion and sediment control measures a builder in South Bend, Mishawaka, or unincorporated St. Joseph County must install and maintain: silt fence, stabilized construction entrances, sediment traps and basins, inlet protection, and prompt seeding or mulching of bare soil. The goal is to keep sediment from washing into the St. Joseph River, the Kankakee headwaters and marsh to the southwest, and the storm sewers of the county's MS4 area. The local review authority approves the SWP3 before land disturbance, and controls must stay in place until the site reaches final stabilization.
Clearing or grading a one-acre site without an approved SWP3, or letting erosion controls fail, violates the CSGP and brings stop-work orders, IDEM penalties, and orders to install and maintain sediment controls.
