Summary

Escambia County requires new construction and substantial improvements inside special flood hazard areas to sit at least three feet above FEMA's designated Base Flood Elevation. LDC section 4-2.4(h) makes the floodplain administrator confirm every construction permit meets that local freeboard margin, on top of the Florida Building Code's own elevation rules, before the county issues it.

These county ordinances apply to unincorporated areas of Escambia County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(h)Other duties of the floodplain administrator. The floodplain administrator shall have other duties, including, but not limited to:(1)In coordination with the building official review all permits for construction within the special flood hazard areas to ensure that the proposed project meets the freeboard requirements. In Escambia County the freeboard requirement is three feet above the designated FEMA Base Flood Elevation.

Full Breakdown

4(h) makes the floodplain administrator responsible, in coordination with the building official, for confirming every permit inside a special flood hazard area meets the local freeboard standard, a three-foot cushion above the designated FEMA Base Flood Elevation, not just the elevation FEMA itself requires. 4(c)-(h) covering review of new development for flood safety, interpretation of flood hazard boundaries, tracking substantial improvement and substantial damage determinations, and coordinating with FEMA when engineering analyses would change base flood elevations or floodway designations, submissions the administrator must forward within six months of the data becoming available.

4(h)(5) directs the administrator to review those certifications for completeness. 4(h)(6). The freeboard requirement applies on top of, not instead of, the Florida Building Code's own elevation rules, so a project can clear the state code and still fail county review if it sits below the three-foot local margin.

Violations & Fines

Building without a floodplain development permit, exceeding what a permit allows, or skipping this article's requirements is a violation under section 4-2.9(a). A structure missing elevation certificates or other compliance documentation is presumed in violation until the owner produces them. The floodplain administrator can issue a notice of violation or a stop-work order to the owner, agent, or the crew doing the work; continuing after that notice draws penalties as prescribed by law. Appeals of the freeboard determination go to the Board of Adjustments.

Frequently Asked Questions

How much above FEMA's flood elevation must I build in Escambia County?
Three feet. Section 4-2.4(h)(1) directs the floodplain administrator to confirm every permit inside a special flood hazard area meets a freeboard requirement of three feet above the designated FEMA Base Flood Elevation, on top of whatever elevation the Florida Building Code itself requires.
Who checks that my project meets the freeboard requirement?
The floodplain administrator, working with the county building official, reviews every permit application inside a special flood hazard area under section 4-2.4(h)(1) and confirms the freeboard standard is met, and again reviews design certifications and elevation documentation under section 4-2.4(h)(5).
Does the freeboard rule replace the Florida Building Code's elevation requirement?
No. It sits on top of it. A project can meet the state Building Code's minimum elevation and still fail Escambia County's review if it does not also clear the three-foot local freeboard margin above the Base Flood Elevation.
