New construction and substantial improvements to residential structures in Schenectady's mapped flood hazard zones must have their lowest floor, including any basement, elevated to at least two feet above the base flood elevation. City Code § 158-17 sets this two-foot freeboard standard for Zones A1-A30, AE and AH, going beyond FEMA's minimum at-BFE requirement.

Full Breakdown

Section 158-17 of the city's Flood Damage Prevention chapter, adopted November 25, 2013, by Local Law No. 1-2013, sets the elevation standard for new and substantially improved residential structures on top of the general anchoring, construction-materials and utility rules in § 158-15 and § 158-16. Within Zones A1-A30, AE and AH, and within Zone A where base flood elevation data exist, the lowest floor, including any basement, must sit at or above two feet over the base flood elevation, a two-foot freeboard margin above FEMA's baseline.

Where no base flood elevation data are available in Zone A, the lowest floor must instead be elevated at least three feet above the highest adjacent grade. In Zone AO, the lowest floor must clear the highest adjacent grade by at least two feet above the depth number printed on the Flood Insurance Rate Map, or by two feet if no depth number is shown, and Zones AH and AO both require drainage paths that route floodwaters around and away from the structure on sloped sites.

The Building Inspector, as local administrator under § 158-11, reviews the as-built elevation certification a permit holder must submit once the lowest floor is in place, prepared and certified by a licensed land surveyor or professional engineer under § 158-13A. Any further construction undertaken before that certification is approved proceeds at the permit holder's own risk, and deficiencies found in the submitted data can trigger a stop-work order.

Violations & Fines

Elevating a new or substantially improved residential structure below the two-foot freeboard standard is a Chapter 158 violation subject to § 158-9's penalty: a fine of up to $250, up to 15 days in jail, or both, with each day of noncompliance a separate offense. The Building Inspector can withhold the certificate of compliance needed to legally occupy the structure until the elevation is corrected and recertified.

Frequently Asked Questions

How high above flood level must a Schenectady home be built?
In Zones A1-A30, AE and AH, § 158-17 requires the lowest floor, including any basement, to sit at or above two feet over the base flood elevation. That two-foot freeboard margin applies to both new construction and any substantial improvement to an existing residential structure in the mapped flood hazard area.
What if my Schenectady property is in Zone A with no base flood elevation set?
Where base flood elevation data have not been determined for a Zone A property, § 158-17A(2) requires the lowest floor, including any basement, to be elevated at least three feet above the highest adjacent grade next to the structure, rather than measured against a formal base flood elevation figure.
Who certifies the elevation of a new home in Schenectady's flood zone?
Once the lowest floor is built, the permit holder must submit an as-built elevation certificate prepared and certified by a licensed land surveyor or professional engineer to the Building Inspector under § 158-13A. Work done before that certification is approved continues at the permit holder's own risk.
