Full Breakdown

Chapter 146, Flood Damage Prevention, was adopted by the Board of Trustees of the Village of Hamburg on 4-15-2019 by L.L. No. 2-2019 and repealed the former chapter adopted 12-21-1987. Under § 146-3A it applies to all areas of special flood hazard within the jurisdiction of the Village of Hamburg. Those areas are defined by Flood Insurance Rate Map panels 36029C0476H, 36029C0477H, 36029C0478H and 36029C0479H, effective June 7, 2019, and by the Flood Insurance Study, Erie County, New York (All Jurisdictions), dated June 7, 2019. The study and maps are on file at Town Hall, Building/Code Enforcement Department, 6100 South Park Avenue, Hamburg, New York 14075.

Section 146-4A appoints the Town of Hamburg Supervising Code Enforcement Officer as local administrator to grant or deny floodplain development permits. Under § 146-4B it is unlawful to undertake any development in an area of special flood hazard without a valid permit. The application is made on forms from the local administrator and may include plans in duplicate showing the nature, location, dimensions and elevations of the area, structures, fill, storage of materials and drainage facilities.

The fee is $50 and $0.02 per square foot. The applicant also reimburses the Town of Hamburg for additional review, inspection and approval costs, and the administrator may require a deposit of no more than $500. Applications must show the proposed lowest-floor elevation, and after the lowest floor is placed the permittee submits an as-built elevation certified by a licensed professional engineer or surveyor. In Zone A with no other base flood elevation data, applicants provide it for developments greater than either 50 lots or five acres.

The administrator issues a stop-work order for any floodplain development found ongoing without a permit or found noncompliant with this chapter or the permit conditions.

Violations & Fines

Under § 146-3E, a violation of Chapter 146 is punishable on conviction by a fine of no more than $250 or imprisonment for not more than 15 days, or both, and each day of noncompliance is a separate offense. A structure without an approved variance under § 146-6 is declared noncompliant and notice is sent to the Federal Emergency Management Agency. Disregarding a stop-work order carries those same penalties.
