Full Breakdown
Chapter 238, Vehicles, Storage of, was adopted by the Board of Trustees of the Village of Hamburg as L.L. No. 3-1998. Subsections B and C of § 238-5 are not limited to residential streets: they cover any private or public property in the Village. Section 238-1 defines a commercial vehicle as any vehicle used in connection with any business or trade, with the exception of the automobile of a salesperson, professional person or the like. A construction vehicle is a commercial vehicle customarily used in the construction trades, including vehicles used for excavation and moving of earth and for hauling of construction materials.
Subsection B prohibits storing any commercial vehicle, tractor, tractor-trailer, semitrailer or construction vehicle outside, except those used by the homeowner for personal transportation. Subsection C prohibits parking them outside unless temporarily in connection with a bona fide commercial service, sales or delivery visit. The chapter defines temporary as a duration less than 24 consecutive hours in the same or proximate location, and it places the burden of proof on the business owner or homeowner. Subsection D exempts Village-owned vehicles and the Light Industrial Zone District from B and C.
Subsection A covers dumpsters: a utility trailer commonly called a dumpster cannot be parked or stored on any public street at any time, and can sit outside on private property only while construction activity is in progress at that premises.
Two other sections add weight and zoning limits. Section 229-15 makes it unlawful to operate a commercial vehicle or tractor, trailer or tractor-trailer combination with a gross weight in excess of three tons on any Village street, unless Schedule XII (§ 229-47) provides otherwise, except to make local deliveries on that street. Section 250-24.9A requires vans and trucks of more than one-ton carrying capacity, unlicensed motor vehicles and motor vehicles used for drag or stock car racing in any residential district to be parked in an enclosed garage, not in front, side or rear yards.
Violations & Fines
Section 238-9 lets any duly authorized police officer, designated official or employee of the Village of Hamburg serve a summons or appearance ticket on the owner, occupant or person in charge of the property. The Village Justice can direct that the vehicle be removed and the violation corrected within 15 days from the return date. If it is not, the Board of Trustees can have the work done and assess the cost against the land as a lien collected as taxes.
